The Caledonia Agricultural Society (“Caledonia Agricultural Society”, “we”, “our”, or “us”) is committed to protecting your privacy.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit www.caledoniafair.ca, use the Caledonia Fair mobile application (the “App”), purchase tickets or other products, register for events, create or use a member account, communicate with us, or otherwise interact with our services.

By using our website or App, you acknowledge that you have had an opportunity to review this Privacy Policy.

1. Who We Are

The Caledonia Agricultural Society operates the Caledonia Fair, Caledonia Fairgrounds, Riverside Exhibition Centre, and related events, programs, and services.

We do not intentionally collect complete credit card numbers or payment card security codes for storage on our own systems.

3. Mobile App Information

When you use the Caledonia Fair App, we may collect additional information necessary to provide App functionality.

Depending on the features you use and the permissions you grant, this may include:

  • Name and email address associated with your member account;

  • Account and authentication information;

  • Information received when you sign in using Google or Apple;

  • Device and operating-system information;

  • App usage and diagnostic information;

  • Push-notification identifiers or tokens;

  • Location information when you grant the App permission to access it;

  • Ticket and purchase information;

  • Event registration information; and

  • Other information you voluntarily provide through the App.

The Caledonia Fair App does not continuously track, monitor, or record your location.

Location information is accessed only when you have granted the App permission to use your device’s location services and when a feature of the App requires or uses location information.

The App does not require you to grant every optional device permission in order to use all core features. Certain features may not work if the relevant permission is denied.

4. Google and Apple Sign-In

The App allows users to create or access an account using Google or Apple, where available.

If you choose to use Google or Apple authentication, the applicable provider may provide us with information necessary to authenticate you and create or access your account.

The information made available to us depends on the provider and your account or privacy settings.

For example, Apple may allow you to use “Hide My Email,” in which case we may receive a private relay email address instead of your personal email address.

Your use of Google or Apple authentication is also subject to the applicable provider’s terms and privacy policies.

5. Member Accounts

If you create a member account, we may use your information to:

  • Create and maintain your account;

  • Authenticate your identity;

  • Provide access to account features;

  • Manage tickets and registrations;

  • Provide information about events and services;

  • Respond to account-related inquiries; and

  • Maintain the security of our services.

You are responsible for keeping your account information accurate and for protecting your login credentials.

6. Location Information

The App may request access to your device’s location services to provide features such as maps, directions, or other location-related information.

The Caledonia Fair App does not continuously track, monitor, or record your location.

Location information is accessed only when you have granted the App permission to use location services and when a feature of the App uses that permission.

You can grant, deny, or withdraw location permission at any time through your device settings.

If you disable location services, certain location-based features of the App may not function properly.

We do not use location information for purposes unrelated to the feature for which it was collected.

7. Push Notifications

With your permission, the App may send push notifications to your device.

Notifications may include:

  • Event reminders;

  • Schedule changes;

  • Important Fair announcements;

  • Ticket-related information;

  • Event updates;

  • Promotions;

  • Contest information; and

  • Other information relating to Caledonia Agricultural Society events and services.

You can enable, disable, or manage push notifications through your device settings.

Where technically necessary to deliver notifications, our service providers may process a device or push-notification identifier.

8. Website and App Usage Information

Marketing communications will include an unsubscribe or opt-out mechanism where required.

You may withdraw consent to promotional communications at any time.

Withdrawing marketing consent does not necessarily stop transactional or service-related communications that are necessary to fulfill a purchase, registration, account, or other request.

When information is no longer required, we take reasonable steps to securely delete, destroy, or anonymize it.

19. Account Deletion

If you have created a member account through the Caledonia Fair App or our website, you may delete your account yourself through the User Preferences section of your account.

When you request account deletion, we will take reasonable steps to delete or anonymize personal information associated with your account, subject to information that we are required or permitted to retain by law or that is reasonably necessary to:

  • Complete or document a transaction;

  • Meet legal, regulatory, accounting, or reporting requirements;

  • Resolve disputes;

  • Prevent fraud or misuse;

  • Enforce agreements; or

  • Maintain required business records.

Information that must be retained will be retained only for as long as reasonably necessary for the applicable purpose and will continue to be handled in accordance with this Privacy Policy.

Deleting your account may result in the loss of access to account-related features, tickets, registrations, preferences, or other information associated with your account.

Deleting the App from your device does not automatically delete your member account. To delete your account, use the account deletion function available under User Preferences.

20. Security

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of personal information.

These safeguards are intended to protect information against unauthorized access, collection, use, disclosure, alteration, or destruction.

No electronic transmission or storage system can be guaranteed to be completely secure.

21. Children’s Privacy

Our events and services are intended for families and people of various ages; however, our website and App are not specifically directed at children.

We do not knowingly collect personal information from children in circumstances where parental or guardian consent is required by applicable law.

Where a child participates in an event, program, contest, or other activity, additional rules or consent requirements may apply.

22. Access and Correction

Subject to applicable law, you may request access to the personal information we hold about you and request correction of information that is inaccurate or incomplete.

You may also ask about:

  • The existence, use, and disclosure of your personal information;

  • The purposes for which information was collected; and

PART III — MOBILE APP TERMS OF USE

Caledonia Fair Mobile App Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Caledonia Fair mobile application (the “App”), operated by the Caledonia Agricultural Society (“Caledonia Agricultural Society”, “we”, “our”, or “us”).

The App is available through the Apple App Store and Google Play Store.

By downloading, accessing, registering for, or using the App, you agree to these Terms. If you do not agree to these Terms, do not use the App.

1. About the App

The App provides information and services relating to the Caledonia Fair, Caledonia Fairgrounds, Riverside Exhibition Centre, and other events, programs, and activities operated or promoted by the Caledonia Agricultural Society.

Depending on available features, the App may allow users to:

  • View Fair schedules;

  • View Fairgrounds and event maps;

  • Browse food, shopping, entertainment, and vendor information;

  • Purchase and access tickets;

  • Create and manage a member account;

  • Register for events and programs;

  • View 50/50 lottery information;

  • Purchase lottery tickets where permitted;

  • Receive push notifications;

  • Access event announcements and updates; and

  • Access information about other Caledonia Agricultural Society activities.

Features may be added, changed, suspended, or removed at any time.

2. Acceptance of Terms

By using the App, you agree to comply with these Terms, our Privacy Policy, and any additional terms that apply to specific purchases, events, contests, promotions, or lotteries.

3. Member Accounts

Certain App features require or permit you to create a member account.

You are responsible for:

  • Providing accurate information;

  • Keeping your account information current;

  • Maintaining the security of your account; and

  • All activity conducted through your account.

You must not create an account using false information or use another person’s account without authorization.

You may create or access your account using an email address and password, Google authentication, or Apple authentication, where those options are available.

We may suspend or terminate accounts that violate these Terms or applicable law.

4. Deleting Your Account

You may delete your Caledonia Fair member account yourself through the User Preferences section of your account within the App.

When you delete your account, your account and associated personal information will be deleted or anonymized, subject to information that we are required or permitted to retain by law or that we reasonably need to retain for legitimate purposes, including:

  • Completing or documenting transactions;

  • Meeting legal or regulatory obligations;

  • Resolving disputes;

  • Preventing fraud;

  • Enforcing agreements; or

  • Maintaining required business records.

Deleting your account may result in the permanent loss of access to account-related features, tickets, registrations, preferences, or other information associated with your account.

Deleting the App from your device does not automatically delete your member account.

To delete your account, use the account deletion function available under User Preferences.

5. Google and Apple Sign-In

The App may permit you to create or access your member account using Google or Apple authentication.

When you use these services:

  • Google or Apple may authenticate your identity;

  • Information may be provided to us to create or access your account;

  • The information provided may depend on your account and privacy settings; and

  • Your use of Google or Apple services is subject to their respective terms and privacy policies.

Apple may allow users to use “Hide My Email,” which may result in a private relay email address being provided to us.

We are not responsible for the operation or privacy practices of Google or Apple.

6. Location Services

The App may request access to your device’s location services for features such as maps, directions, or other location-related information.

The Caledonia Fair App does not continuously track, monitor, or record your location.

You can grant or deny location permission through your device.

You can change location permissions at any time through your device settings.

Certain features may not work if location permission is denied.

Our collection and use of location information is described in our Privacy Policy.

7. Push Notifications

With your permission, the App may send push notifications concerning:

  • Event reminders;

  • Important Fair announcements;

  • Ticket information;

  • Promotions;

  • Contest information; and

  • Other Caledonia Agricultural Society communications.

You can manage push notifications through your device settings.

Disabling notifications may prevent you from receiving certain updates.

8. Tickets and Purchases

The App may permit users to purchase tickets or other products and services.

Purchases are subject to the terms, prices, fees, refund policies, event rules, and other conditions presented at the time of purchase.

We may change ticket prices, availability, event schedules, locations, entertainment, or programming.

If an event is cancelled or changed, any applicable refund or exchange will be handled according to the applicable event or purchase terms and applicable law.

9. Payment Processing

Payments may be processed by third-party payment providers.

The Caledonia Agricultural Society does not intentionally store complete payment card numbers or card security codes.

Payment providers may collect and process payment information under their own terms and privacy policies.

10. 50/50 Lottery and Promotions

The App may provide access to information about lotteries, contests, promotions, and fundraising activities.

Participation is subject to the official rules applicable to each activity.

If there is a conflict between these Terms and the official rules of a lottery, contest, or promotion, the official rules will govern.

Participants must meet all applicable eligibility and age requirements.

These Terms do not replace or modify the official rules for Ontario Fair Fortune 50/50 or any other lottery.

11. Event Information

We make reasonable efforts to keep event information accurate and current.

However, schedules, times, locations, admission requirements, entertainment, vendors, prices, and programming may change.

We do not guarantee that information in the App will always be complete, accurate, or current.

The most recent official communication from the Caledonia Agricultural Society will govern where event information changes.

12. Privacy

Use of the App is subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information relating to:

  • Member accounts;

  • Google and Apple authentication;

  • Ticket purchases;

  • Push notifications;

  • Location services;

  • Analytics;

  • Device information; and

  • Other App functionality.

13. Intellectual Property

The App and its contents, including logos, trademarks, photographs, graphics, artwork, text, software, designs, event information, and other materials, are owned by or licensed to the Caledonia Agricultural Society.

You may use the App for your personal, non-commercial purposes.

You may not copy, reproduce, distribute, modify, commercially exploit, reverse engineer, or create derivative works from the App except where permitted by applicable law.

14. Acceptable Use

You agree not to:

  • Violate applicable laws;

  • Impersonate another person;

  • Create fraudulent accounts;

  • Access another user’s account without authorization;

  • Interfere with the App;

  • Attempt to bypass security measures;

  • Introduce malicious software;

  • Manipulate ticketing, payment, contest, or lottery systems;

  • Use automated systems to access the App without authorization;

  • Submit fraudulent or misleading information; or

  • Use the App for unlawful or fraudulent purposes.

15. Third-Party Services

The App may interact with third-party services including Wix, Google, Apple, payment processors, ticketing providers, mapping services, analytics providers, and other service providers.

Third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party services or their availability, content, security, or privacy practices.

16. App Availability

We will make reasonable efforts to maintain the App but do not guarantee uninterrupted or error-free operation.

The App may become unavailable because of:

  • Maintenance;

  • Updates;

  • Technical problems;

  • Internet or telecommunications failures;

  • Third-party service interruptions;

  • Device compatibility issues; or

  • Circumstances beyond our reasonable control.

We may modify, suspend, or discontinue the App or any feature at any time.

17. App Updates

We may release updates to improve functionality, security, compatibility, or performance.

You may need to install updates to continue using certain features.

18. Disclaimer

To the fullest extent permitted by law, the App is provided on an “as available” basis.

We do not guarantee that:

  • The App will meet your requirements;

  • The App will always be available;

  • The App will be error-free;

  • Information will always be accurate or current; or

  • The App will be free from harmful components.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, the Caledonia Agricultural Society and its directors, officers, employees, volunteers, agents, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the App.

This includes losses resulting from technical failures, third-party services, inaccurate information, event changes, ticket availability, or device problems, to the extent permitted by law.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless the Caledonia Agricultural Society and its directors, officers, employees, volunteers, agents, contractors, and representatives from claims or expenses arising from your:

  • Violation of these Terms;

  • Misuse of the App;

  • Violation of applicable law; or

  • Infringement of another person’s rights.

21. Termination

You may stop using the App at any time by deleting it from your device.

We may suspend or terminate access to the App or your account if you violate these Terms or applicable law.

Provisions concerning intellectual property, privacy, disclaimers, limitations of liability, indemnification, and governing law will survive termination where applicable.

22. Apple App Store

If you download the App from the Apple App Store, these Terms are between you and the Caledonia Agricultural Society and not Apple Inc.

Apple is not responsible for the App, its content, maintenance, support, or warranty except as required by applicable law.

Apple has no obligation to provide maintenance or support for the App.

Apple is a third-party beneficiary of these Terms and may enforce applicable provisions against you.

Your use of the App must also comply with applicable Apple App Store terms and policies.

23. Google Play Store

If you download the App through Google Play, your use of the App is also subject to applicable Google Play terms and policies.

Google is not responsible for the App, its content, maintenance, support, or warranties except as required by applicable law.

These Terms are between you and the Caledonia Agricultural Society and do not create an agreement between you and Google.

24. Changes to These Terms

We may update these Terms to reflect changes to the App, our services, applicable law, or third-party platforms.

The “Last Updated” date will identify the current version.

Where appropriate, material changes may be communicated through the App or another reasonable method.

Continued use of the App after revised Terms take effect constitutes acceptance of the revised Terms.

25. Governing Law

These Terms are governed by the laws of Ontario and the applicable laws of Canada.

Any dispute relating to these Terms or your use of the App will be subject to the applicable courts of Ontario, subject to any mandatory rights or protections provided by law.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.

27. Entire Agreement

These Terms, our Privacy Policy, and any additional terms applicable to specific purchases, events, contests, promotions, or lotteries constitute the agreement between you and the Caledonia Agricultural Society concerning your use of the App.

Where specific terms apply to a particular product, event, contest, lottery, or service, those terms will apply in addition to these Terms.
